According to Section IV of the Federal Government Decree,

1. all federal authorities and offices, including the Federal Employment Agency, shall display the federal institutions flag and – if the technical prerequisites exist – the European flag;
2. the other public-law corporations, institutions and foundations shall display the federal flag and – if the technical prerequisites exist – the European flag.

In case of doubt concerning the entitlement to display the federal institutions flag, the competent highest federal authority in agreement with the Federal Ministry of the Interior decides which flag is to be displayed.
